Court says no to death penalty for serial killer
The Pennsylvania Supreme Court has ruled that a convicted serial killer should serve life sentences for his crimes instead of facing the death penalty because he is mentally disabled.
The court Wednesday upheld a Dauphin County judge's Aug. 25 ruling that vacated 2 death sentences for Joey Miller of Steelton.
Miller was convicted in March 1993 of murdering 2 women in Dauphin County.
Judge Jeannine Turgeon initially vacated the sentences in December 2002, citing a U.S. Supreme Court ruling that banned the executions of people who are mentally disabled.
The state Supreme Court sent the case back to Turgeon after prosecutors appealed.
Dauphin County prosecutor Ed Marsico says he hasn't determined what he'll do next in the case.
