GA: Death Penalty Appeal
The Georgia Supreme Court has a hearing scheduled for the death penalty case of Frederick Whatley, condemned for the 1995 killing of a Griffin businessman.
The court will hear arguments Monday on Whatley's appeal of a Superior Court denial of his petition for habeas corpus, which would allow him to challenge his conviction in Butts County where he is held on death row for the murder of Ed Allen, owner of Roy's Bait Shop.
The Supreme Court upheld Whatley's conviction and sentence in 1998, and the U.S. Supreme Court refused to hear his case in 1999.
Defense lawyers argue that the habeas judge made a number of mistakes and his trial attorney failed to prepare his case properly.
