Paratrooper's attorneys dispute death penalty


Attorneys for a paratrooper charged with killing 1 soldier and injuring 18 other during a shooting more than a decade ago are challenging the fairness of the military's death penalty.

The Fayetteville Observer reported that defense lawyers for Sgt. William J. Kreutzer Jr. argued during a pretrial hearing Tuesday at Fort Bragg that he would have more legal protections in civilian court than in a military court. As an example, the lawyers said military attorneys don't have to show they are qualified to handle death penalty cases like those in civilian court.

Kreutzer was sentenced to death in 1996 at a court-martial, but an appeals court overturned the sentence. A gunman who fired at a formation of 82nd Airborne Division soldiers in 1995 killed one and wounded 18.
